a. Witness Professor Reyntjens (PW77) asked permission to address the Chamber. First, he advised the Chamber that he had made an error in an answer he had given yesterday and offered further explanations. Second, he advised the Chamber that he had been given documents yesterday by Counsel for Bagosora (Mr. Constant), some of which were stamped “confidential” and which he recognized as being documents which he had himself given to a Belgian examining magistrate on condition that they be kept confidential. Witness Reyntjens expressed his concern that these documents had been widely disseminated and indicated that he would in future be reluctant to share such information with judicial authorities. The Prosecution (Ms. Mulvaney) explained that the documents had originated from the Prosecution and may have been disclosed in error, as it was difficult to keep track of which documents might be non-disclosable under Rule 70. She further suggested that the documents, or information contained therein, be placed under seal. Finally, she suggested that some of the documents should be returned to the Prosecution. Counsel for Bagosora (Mr. Skolnik) objected to the return of any documents. Mr. Constant indicated that the documents were disclosed by the Belgian authorities in response to requests from the Prosecution and that the legal status of the confidentiality was uncertain. He indicated that sensitive information would be treated with discretion. The Presiding Judge asked the witness to assist the parties in signaling sensitive information in order to prevent wider disclosure.
